Quarterfall ONE Privacy and Cookie Notice

We are QUARTERFALL. We are based at Jan van Eycklaan 2, 3723BC Bilthoven, The Netherlands. You can contact us at [email protected] if you have questions about data protection, or if you have any requests for resolving issues with your personal data. You can also write to the above address.

In this privacy notice we describe:

  • The ways we collect personal data about you when you use the Quarterfall ONE Service and why we do so
  • How we use your personal data, and
  • The choices you have about your personal data.

Note, this notice only describes how we handle your data when you use Quarterfall ONE service. When you use any other Quarterfall service, including Quarterfall PRO via your institution, we operate as a “processor” of data, in that we process data on our platform solely on behalf of and on instructions from our customers – the institution that you are a teacher or student at and that gave you access to Quarterfall – and for no other purpose.

We are committed to a lawful, fair and transparent processing of personal data.

1. The data we process

There are two ways that we obtain data from our users.

One, when they sign up for an account, we obtain a name (first and last) and an email address.

Two, when they use our service for assignments, any data that is actively shared on the platform and that contains personal data.

2.  What do we use the data for

We use the account data and the assignment data to provide you with your access to the Quarterfall service.

3. Our legal basis for processing data

For the account data and the assignment data, we base our processing on the performance of our contract with you to provide the Quarterfall service.

4. Who we share data with

If you are a teacher, we share your name and assignments (and any personal data in it) with the students that access your assignments, and your feedback on an assignment for an individual student with that individual student.

If you are a student, we share your name with the teacher if you access their assignments. We also share your answers (and any personal data in it) with the teacher if you do their assignments.

We share data with our hosting party, a processor acting on our behalf.

We may release your data when we are required to by a court order, according to law or in the event of a bankruptcy or other similar unfortunate event. We may also share and may acquire your data with future subsidiaries or companies if we choose to sell, transfer or merge parts of our business. We will, however, only transfer the data if we must and if these companies comply with applicable privacy regulations.

5. How long and where do we store data

We store your account and assignment data for as long as you have an active account.

If your account is inactive for 3 years, we will delete your account and your assignment data. Before we do so, we will send you a reminder.

Data related to an assignment can also be deleted when the teacher deletes that particular assignment.

6. How do we protect data

Taking into account the nature, scope, context and purpose of the processing, we have taken the following technical and organizational measures:

  • Our databases, and the information contained therein, are protected with access control. We use 2FA whenever possible.
  • Access to databases is limited, not all staff in our organization have full access.

We do not actively monitor the security of our databases and need to rely on our hosting and other providers to notify us of any data breaches.

7. If you are in Europe - transfer of your personal data

You should also know that your personal data may be transferred from your home country to third parties. If you are an EEA or UK resident, this could imply that we also transfer data to countries that do not offer an adequate level of protection for your personal data. When we transfer this data, we will do so only when we have put in place appropriate safeguards to protect your personal data. Please contact us to get a copy of the safeguards that we have put in place. Our contact details are at the bottom of this text.

8. If you are in California (USA) - do not track and do not sell my data (opt-out)

We do not sell your data. For website visitors from California (USA), our website does not respond to Do Not Track (DNT) signals.

9. Your Rights

No matter where you live, you have the right to request access to your personal data that we process. You also have the right to:

  • Rectify incorrect personal data or erase it in certain circumstances.
  • Restrict or object to the processing of your personal data.
  • Receive your data so that you can use it elsewhere (data portability).

Where we process data based on your consent, you also have the right to withdraw your consent at any time but we would like to point out that this does not affect the lawfulness of the processing before the date that you withdrew your consent.

If you wish to exercise any of the above rights, please write us at [email protected].We will respond to all requests within a reasonable timeframe, but at least within 4 weeks.

The easiest way to delete all your data is to delete your account, but keep in mind that if you are a student, your teachers will no longer have access to your answers, and if you are a teacher, you will no longer have access to any student answers. For us it is only technically possible to delete entire accounts, not individual assignments or other data.

If you are based in an EU Member State, you also have the right to lodge a complaint with your local EU data protection authority for unresolved complaints.

10. Young users

Protecting the privacy of children is of the utmost important to us and we do our best to meet both EU and U.S. standards. Our service is expressly directed at higher education, and not at young people.

This means that generally, we do not expect to process personal data of users younger than 16, except in limited circumstances such as for vocational type schools available to students that are 15 years old or younger students participating in university programs.
